Shipping policy
ARTICLE 1: OBJECTIVE
This shipping policy is intended to define the terms and conditions applicable to the shipment of a Product to the Customer by the Publisher.
ARTICLE 2: PARTIES
This shipping policy applies between Sammy Voigt, sole proprietor, registered with the Paris Trade and Companies Register in France on 22/08/2024, under number 932 196 546, with headquarters at 9, Rue des Deux Ponts, 75004 Paris, France, phone: +33 (0) 627567769, email: info@kbeautyshop.fr, hereinafter "the Publisher," and any individual or legal entity, public or private, registered on the Site to purchase a Product, hereinafter "the Customer."
ARTICLE 3: DEFINITIONS
- "Customer": any individual or legal entity, public or private, registered on the Site.
- "Site Content": elements of any nature published on the Site, whether protected by intellectual property rights or not, such as texts, images, drawings, presentations, videos, diagrams, structures, databases, or software.
- "The Publisher": Sammy Voigt in his capacity as publisher of the Site.
- "Internet User": any individual or legal entity, public or private, connecting to the Site.
- "Product": goods of any nature sold on the Site by the Publisher to the Customers.
- "Site": the website accessible at the URL kbeautyshop.fr, including linked sub-sites, mirror sites, portals, and URL variants.
ARTICLE 4: SCOPE
The Site is open and free to all internet users. Browsing the Site implies acceptance by any internet user of this shipping policy. Simply connecting to the Site, by any means, including through a robot or browser, constitutes full and complete acceptance of this shipping policy. Upon registration on the Site, this acceptance will be confirmed by checking the corresponding box.
The internet user acknowledges having read and accepted these terms without restriction. Checking the aforementioned box will be considered equivalent to a handwritten signature by the internet user. The internet user recognizes the evidentiary value of the Publisher's automatic registration systems and, unless proven otherwise, waives the right to contest them in case of a dispute.
This shipping policy applies to relations between the parties to the exclusion of all other conditions, including those of the internet user.
Acceptance of this shipping policy assumes that the internet user has the necessary legal capacity to do so, or if not, that they have authorization from a guardian or curator if they are minors or incapacitated, or from their legal representative if acting on behalf of a legal entity.
ARTICLE 5: DELIVERY
5.1. Shipping Costs
Shipping or handling fees will always be indicated to the Customer before any payment and only apply to deliveries made in mainland France, including Corsica. For any other delivery location, the Customer must contact customer service.
If the Product is delivered to the Customer in a store or a partner location of the Publisher, the relevant fees are specified to the Customer at the time of order.
The shipping fees indicated on the Site are in euros, inclusive of all taxes.
5.2. Delivery Time
Orders are delivered by La Poste within 3 business days from the Publisher’s full receipt of the payment.
Certain products or order volumes may justify a longer delivery time than 4 business days. This will be expressly communicated to the Customer during order confirmation.
5.3. Damaged Package
In case of delivery of a visibly damaged package, the Customer must refuse it to benefit from the carrier's warranty. The Customer must also promptly notify the seller so that a new package can be prepared and shipped upon receipt of the damaged one. In such cases, the delivery times indicated above will no longer apply.
5.4. Reservation of Ownership – Transfer of Risk
The ownership of the delivered Products remains with the Publisher until the Products are delivered to the Customer, despite any contrary clause, unless the parties have expressly agreed in writing to waive this clause.
The Customer bears the risks associated with the Products from the time of order. During the entire reservation of ownership period, the Customer must insure the Products owned by the Publisher at their expense against any damage that may occur and justify this to the Publisher upon first request.
ARTICLE 6: FINAL PROVISIONS
6.1. Applicable Law
This shipping policy is subject to the application of French law.
6.2. Modifications to this Shipping Policy
This shipping policy may be modified at any time by the Publisher. The shipping policy applicable to the Customer is the one in effect on the day of the order or connection to the Site. Any new connection to the personal space implies acceptance, if applicable, of the new shipping policy.
6.3. Disputes
In accordance with Order No. 2015-1033 of August 20, 2015, any disputes with a consumer Customer arising in the context of the execution of these general conditions, and which could not be resolved amicably between the parties, must be submitted to Medicys: www.medicys.fr.
Additionally, the consumer Customer is informed of the existence of the online dispute resolution platform, accessible at the following URL: https://ec.europa.eu/consumers/odr/main/?event=main.home2.show.
Any dispute relating to or in connection with this contract will be settled by arbitration in accordance with the rules of the Digital Institute of Arbitration and Mediation: www.fast-arbitre.com.
6.4. Entire Agreement
The nullity of any clause in this contract will not result in the nullity of the other clauses or the entire contract, which will retain its full effect and scope. In such cases, the parties must replace the invalid provision with a valid one that corresponds to the spirit and purpose of this agreement.
6.5. No Waiver
The Publisher’s failure to exercise the rights granted by this agreement cannot be interpreted as a waiver of those rights.
6.6. Telemarketing
The Customer is informed that they have the option to register on the telemarketing opt-out list at http://www.bloctel.gouv.fr/.
6.7. Language of This Shipping Policy
This shipping policy is available in French.
6.8. Unfair Clauses
The provisions of this shipping policy are subject to compliance with the mandatory provisions of the Consumer Code regarding unfair clauses in contracts between professionals and consumers.
